Notice Regarding Hemp-Derived Products

Cities Hemp offers products represented and labeled as hemp-derived products.

Some products may resemble marijuana in appearance, aroma, packaging, or cannabinoid content. Visual appearance or odor alone may not establish a product’s legal classification.

Federal Hemp Definition

Under the federal framework established by the Agricultural Improvement Act of 2018, hemp is generally defined as Cannabis sativa L. and its parts and derivatives containing no more than the legally permitted concentration of delta-9 tetrahydrocannabinol on a dry-weight basis.

USDA materials describe the federal hemp threshold as not more than 0.3% delta-9 THC on a dry-weight basis. USDA production testing also accounts for the potential conversion of THCA when determining total THC during preharvest compliance testing.

Federal classification does not eliminate separate state or local restrictions. Laws governing hemp, THCA, cannabinoids, finished products, possession, sale, transportation, and testing vary among jurisdictions and may change.

Product Documentation

Where applicable, Cities products may be accompanied or supported by documentation such as:

• Product labels.
• Batch or lot identifiers.
• Certificates of analysis.
• Laboratory-testing information.
• Order confirmations or invoices.
• Shipping documentation.
• Website product records.

A certificate of analysis reflects the tested sample and batch identified in the report. It should be evaluated together with applicable law and any other relevant evidence.

Request for Verification

Before determining that a Cities product is unlawful based solely on its appearance, odor, or resemblance to marijuana, we respectfully request that law-enforcement personnel:

1. Review the product packaging and labeling.
2. Identify the product’s batch or lot number.
3. Review any corresponding certificate of analysis.
4. Consider the applicable federal, state, and local legal definitions.
5. Use an appropriate validated testing method where chemical analysis is necessary.
6. Contact Cities for available product or order documentation.

Important Legal Qualification

Cities does not claim that every hemp-derived product is lawful in every state or locality.

This Notice:

• Does not prevent lawful investigation, detention, seizure, testing, or enforcement.
• Does not constitute legal advice.
• Does not override state or local law.
• Does not establish the legality of a specific product in a particular jurisdiction.
• Does not guarantee that field-testing equipment can distinguish among hemp, marijuana, THCA, delta-9 THC, or other cannabinoids.
• Does not waive any rights or remedies available to Cities, a purchaser, a carrier, or another party.

The current Notice should not retain its existing statements that the products are “perfectly legal” in every state or that only delta-9 THC is relevant in all circumstances. Those are overly broad legal conclusions and do not account for differing state laws or USDA’s total-THC production-testing framework.

Secure Storage and Adult Possession

Cities products are intended only for adults who are at least 21 years old and legally permitted to possess them.

Products should be:

• Kept in their original packaging.
• Stored securely.
• Kept away from children and pets.
• Possessed and transported only as permitted by applicable law.
